- Beth replies to BigA| 3 repliesWe did have a lien put on our house! But we owe more than it would ever sell for. So they still wouldn’t get their money. I offered a payment. What we could afford. They said it wasn’t enough. So at least I tried
- CWG40 replies to BethWho, exactly, put the lien on your house? And who, exactly, did you offer the payment to?
In any event, liens are strictly controlled by state law. Debt collectors cannot place liens on houses. Or any property.
Any lien placed against you would have to be in accordance with state law and be recorded somewhere.
Yes, if someone got a judgement against you, then the judgement would constitute a lien on your property.
Did someone get a judgment against you? - MikeHuntleton replies to Beth
Then you must have had a Court Judgment against you for anyone to be able to put a lien on your house. With a Judgement, they have more options to get your money.Quote:We did have a lien put on our house! - BigA replies to BethNo one can just put a lien on your house. The mortgage company can do it because you agreed to it when you took out the loan. Taxing authorities can do it administratively if you owe a lot in back taxes. Other than that, no debt collector can simply put a lien on the house. They have to file suit, properly serve you, go to court, win their case and obtain a judgement. At that point, depending on state law, the judgement might be considered a lien on real property.
Now one of the key points is in the "win their case". Generally what happens is people don't go to court and the DC gets a default judgement. Is that what happened? - Christina CrailThese people keep calling me and if I answer they would not say a word. I don't answer them anymore. I am going to try to get this number blocked if I can!!!

I have some Medical Debt So I know It was a valid call but i Just find it weird that They didn't identify the company when They called.

- Actually.. replies to TamraHow do you know they have the right to collect said alleged debt? Did they mail you the required dunning letter - as per federal debt collection laws?
- AnnoyedThey call every day and refuse to leave a message but when they do it is "someone from this number needs to call us". When you return the call they want to know the name of every person living in your home before they will tell you what they want, I wouldn't give them the names. They continued to call so we blocked their number and they still continue to call every 10-11 minutes every day. Good thing the phone doesn't ring, it's just annoying having to delete all the calls from caller id. If they would've just told us what they wanted without needing so much info and without being so hateful.

- Experienced replies to goofHaving been stupider in my youth, I failed to pay a large hospital bill and, eventually the hospital did obtain legal approval to garnish my payroll check, at which time I worked for the county. So, unfortunately, you can be garnished if you fail to work with the hospital to pay off the debt.
- RicCaller claims to be law firm collecting a debt. My lawyer called the real firm and was told this a scam spoofing their name and no refference of my name, my phone # nor the account number robocaller claims as my account in question.
- Caller: Spoofing a real law firm; when u call real firm they say this number spoof scam

- WB replies to AshleyIt’s from Valarity
- BigAYou will need to send them a certified, return receipt debt validation (by law they have to go back to the original creditor to prove you owe the debt), cease and desist calling, or "not me" letter (this will be the best money that you have ever invested). Also send it first class mail in case no one will sign for it. Make a notation of that fact at the bottom of the letter. You also need to report them to the proper agencies to which I have provided links to. Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment. If everyone did these three things, these crooks would be bankrupt, and we would all be the richer for it. Use these web sites to find an attorney in your state that will probably take the case on a contingency basis (no money out of your pocket up front): http://www.consumeradvocates.org/

Everything else you need to know follows including at least two or more federal and state agencies where you should report their criminal activities.

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/
Also file complaints with the FTC: https://www.ftccomplaintassistant.gov/#crnt&panel1-1
Also file a complaint with your State Attorney General's office.

I answered after I saw it was Receivable Solutions, but didn't stay on the phone to talk to anyone because I know my credit report is clear and nothing is in collection.

- Dwight LeeThe caller has zero rights - YOU have 100% of the rights in this situation, so you demand that they give you the company name, their nme, the purpose of their call, and where they got your number - if they refuse any of this YOU become the Gestapo - tell them that they are in precise violation of federal law and you WILL prosecute... don't by into their obvious bluff - tell them to shup up and answer your questions or get off your phone and never call again or you will sue - YOU play the obnoxious powerful person - or you get what your wimpishness get you!

- Hadley| 1 replyA man called me asking for someone over and over again, i was asking who he was (as in what is the business) he kept avoiding the question. I would like to know who is calling my cellphone. I have to pay for minutes. Its not right when they keep harassing me. Im tired of random calls looking for a different person everytime. The man would not tell me who he worked for. That seems very unprofessional and fishy. Im tired of paying for minutes Because of them. I get about 5 calls a day telling them not to call me anymore. It doesnt stop.

- GregAtTheBeach replies to HadleyHad you considered simply blocking their number? The ability is built-in to most modern cell phones. If it's not, download a blocker app that will. It's *your* phone. You get to decide how it's used.
