    Now I posted on Page #16 Nov 25th my experience with phone # 1888-748-4956. I am not the individual they are looking for. I explained this to the rep on Nov 25th, and got hung up on waiting for a manager. This number called my business AGAIN today, and when I asked for a manager, I was hung up on.

    This time I called the number back and asked for a manager. The company is Allied Interstate a collection company for various unsecured credit card debt. I ask how they obtained my business number, but did not receive an answer. I explained that the repeated calls to a work line on a debt that is not mine was a clear violation to the National Debt and Collection Fair Practices Act.

    This is happening in New York and I do understand our Attorney General is currently running a "crack-down" on this debt harassment.

    I pay my bills, I do not have unpaid debt, yet I still have to be bother at my place of business.

    Under the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.  

    Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.

    This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc.  NCO Group is a debt collector that uses automated prerecorded collection calls.  In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc.  Mr. Watson filed suit under both the FDCPA and TCPA.

    David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors.  Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call.  Judge Davis wrote;

    [The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.

    Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.  

    So what can you do if you receive "wrong number" calls from debt collectors?

    1. Sign up for the Do-Not-Call registry.
    2. Save the calls captured by your voice mail or answering machine.
    3. Contact a consumer lawyer.

    I GOT CALLED TPODAY AT 8:30AM EST.????  i ASKED THEM IF THEY KNEW WHAT TIME IT WAS AND HE MAN FROM INDIA (SOUNDING) SAID "WHAT?"  NEXT CALL I ANSWERED BY SAYING "fib hq>!"  WOW DID THEY HANG UP.  IF THIS IS FROM CAPITOL ONE CERDIT I WILL CALL THEM AND LET THEM KNOW THAT THIS IS HARRASSMENT AND STRAT THE SUEING PROCESS!!!!

    You are quick to assume that, but everyone does not have debt. These folks get the old number for a customer and keep calling. They call my house and they insist that the person lives there cause that's the number they gave them. Well they are wrong.

    I keep getting calls from this phone number--about one every hour. They never leave messages and when I call them back I get a voicemail that says I need to call back during business hours--even at 1PM.  I just got this phone number two days ago--so I'm curious as to how they got it.

    I live in Plymouth, Indiana. For about a month now I am receiving 15 to 20 calls a day, sometimes within 2 to 3 minutes. They start at about 8:30am until sometimes 10:45pm at night. My caller id just shows 1-888-748-4956, but it shows no name, just unavailable. I am on the no call lists and am not behind on any payments. Luckily I have caller id, I would be very pissed off to be answering the phone all of the time, still is annoying, but I just shutoff the ringer.

    I am getting these calls daily and it is disrupting my work and productivity!  I do not want to receive them.  My credit rating is excellent and I don't owe any money to anyone!  I request this number be removed from my work number calling list. My number is: 910.452.8704 Thanks!

    you should not have posted your phone# on an open forum. it is pretty clear in the posts here that this thread is for people to get information on a certain phone number that many people (myself included) have gotten the calls FROM. this forum is not for the business itself that is making the calls. stating here to REMOVE you from their list does no good because that company will not read these posts. you just open yourself up to people finding your number and using it. if you can, i recommend deleting that post immediately. just some friendly advice :-)

    I have gotten calls manytime for Cap1 and also for a old sprint accout that I use to have, that I have already paid off. This is a woman that is African American. Sound not to be in a call center and woman seems shacky not confident.Has also called a couple phone numbers linked to me but not in my name. SHe calls each number like twice  a day for last three weeks. Going fearther... I got a text on my phone saying my bank had locked my account for security reasons. Gave me a number and when I decided to call the bank and not the number given. bank told me to igore this message.

    DO THIS-IT WILL PAY OFF!!  Go to donotcall.gov and file a complaint. You can file whether you are on the do not call list or not. I know this is effective because 1. I've done it, 2. I've stopped receiving calls, 3. I've actually received "apology" letters from collectors. I file as many times per day that they call at donotcall.gov. In addition, I repeat that action at the BBB, the FTC, and my state's AG office (again, every call will warrant a complaint from me so for those companies that auto call several times per day, that means trouble from them). They get VERY MAD when the tables are turned, which makes it all the more fun. Only scumbags of this Earth make a living collecting from others. This debt following me belongs to my dead brother-it isn't even mine.

    I DO NOT answer calls that provide no Caller ID information.  If it is so important that they get in touch with me, they can leave a voice message. Since 18 Dec I have received 21 calls from 888-748-4956 at various times, which is listed as Not Provided on the Caller ID. I am not sure how many before then I received because my Caller ID only holds so many calls.

    this number keeps calling me but when i answer there's no one there or they just ask for information that i won't give over the phone so i got on the national do not call list you can do this by calling 888-382-1222 or going to www.donotcall.gov
