Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of the date of the letter and if you do so, all collection activity must be stopped until the debt is verified.

Hell, I've even read that even if the debt was legit, it's legit with a different company so if you do owe it, you don't owe anything to the collector by law (no contract).

- PatriceJust got a call the other day, they didn't leave a message. For years, I've been getting collection letters from different agencies until it ended up with Portfolio Recovery, for a bill that is now way beyond the statute of limitations. Recently I started getting collectiion letters from them (again), but this time at the bottom of the letter, after the "you have 30 days to dispute" summary - it states this - "Because of the age of your debt, we will not sue you for it and we will not report it to any credit reporting agency"

- Sick & Tired866-519-8330: So if this is Portfolio Recovery, they are in so much trouble, I have filed Bankruptcy and all the letters have been sent so they got one, turning over to my lawyer to rip them a new one! And the fact they call 05/20/2015 and the case was filed 02/28/2015 and all letters went out so they definitely in trouble! I Love It!
