Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of the date of the letter and if you do so, all collection activity must be stopped until the debt is verified.

I managed to get the person on the phone last month to give me personal privacy act info about the person they were calling for. I record all my calls and with the latest privacy act violation I found the woman they are looking for and gave her some disturbing privacy act info given to me from this company that is desperate. Remember this STATUE OF LIMITATIONS.

Once they have a match they keep calling. Their is no way they had my cell phone number prior to me posting my resume.

- Chantie| 1 replya woman called from this number looking for my fiance. When I asked her for her name and number for me to give to him, she asked for a personal phone number of his. I wouldn't give her the number and asked what it was about, all she would say is "mmm, No, I'll try back at a later time" and hung up. According to my reverse look up app on my phone. The name is Laurie Beck and it came back with an address of 640 Avenue B Bushton, KS.

Some Tips:
*Keep all messages
*Take a picture of your Caller ID
*Keep any and all conversations recorded to your states recording laws, some require they be told, others do not. This can be transferred to a recording device.
*Keep a notebook handy for writing time,date, who you spoke with and what the conversation detailed.
*Check your SOL for your state as well.
*Attorneys need to be licensed as a DC to collect, all DC's must be licensed in their state as well as yours if different.

- RidoThese guys (Portfolio Recovery) are genuine bottom feeders of debt collection industry. They buy old statute expired debt and through harassment tactics try to collect 10 to 30 cents on the dollar. Of course the minute anything is collected, the statute date resets to day 1 and their other outfits and ambulance chasers come after you. If you have noticed their letter of settlement is only for the debt with them, not original debtor or the next place they sell it to. The only way to fight these guys is to get with your state authorities. These guys know all the Federal loopholes.

- SusanIf this is a collection agency there are laws they must follow. First they can call as many times as they like until they get you. Then it's once every seven business days, week-ends are not considered business days. They have to provide proof of the actual debt within 24-48 hours. There is a statue of limitations of two years that they can take legal action on the debt. I found that if I don't speak with them they do go away. The law says that you have to acknowledge the debt. Am researching this out for more info as to what this means.
