Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of the date of the letter and if you do so, all collection activity must be stopped until the debt is verified.

They did that to me and I sent them a certified C&D with signature request (leaving only written USPS communications open) and demanded written validation and proof from the original owner of the alleged debt.
Those parasites sent me nothing but one of THEIR own invoices. Sent it back disputing the original debt as well as their claim. That was 4 years ago. Never heard from them nor was a 1099-c filed by them. They have the morals of an allycat. No! I stand corrected. Some Tips:
*Keep all messages
*Take a picture of your Caller ID
*Keep any and all conversations recorded to your states recording laws, some require they be told, others do not. This can be transferred to a recording device.
*Keep a notebook handy for writing time,date, who you spoke with and what the conversation detailed.
*Check your SOL for your state as well.
*Attorneys need to be licensed as a DC to collect, all DC's must be licensed in their state as well as yours if different.

Yes, the BBB is a toothless entity bottom line, and they tend to lean to their paying customers, still its a "paper trail" and can be used against them. This is why its important to follow through with any complaint there.
- If the debt was covered... replies to Average Joe...in bankruptcy, you can sue them for violating bankruptcy protection laws. Contact the lawyer who handled your bankruptcy and let them know you're being harassed. Also report them to your state's Attorney General. Bottom line, their calls - and letters - are illegal. Debt covered in bankruptcy cannot be "recovered"!
