- CWG40 replies to Celeste freemanCall blocker might be helpful. PR is known, however, for calling from thousands of different numbers. Cease and Desist letter might also be helpful if they get too wild. Also, don't pick up on numbers you don't recognize. There's no easy answer when dealing with PR. They're the 70,000 Ton freight train of the debt collection business. Damned hard to stop. God knows how many employees they have--they must make thousands of calls a day.
- jinxGot a call from them on a Sunday morning. Asked for a person that has not had the name they asked for them by for over 13 years. Anything they are calling on for that one is far gone from the statute of limitations for most debts. Not to mention if they really knew their stuff they would have been aware of the name change. It isn't that hard to find those types of things out. I simply told them that no one by that name lived here. It was the truth.

- You Get Nothing| 1 replyPortfolio Recovery has bought several thousand dollars of my debt (fools) I will not pay a dime and since I am on permanent SSI/SSD they won't be able to collect however hard they try. They use dozens of different numbers in their lame attempt to recoup their loss. They are easily IDed and ignored yet they keep wasting time and money trying. Maybe they feel if they call hundreds of times with hundreds of numbers they might feel some sort of satisfaction because they will never get any by collecting a cent from me. BWHAHAHAHAHHAAAAA
I could just answer the phone and let them off the hook but I would rather people like this keep spending even more money in a wasted attempt. I like it when they go to court and find out they can't touch any of my money. Ka Ching!!!- Call type: Debt collector

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of the date of the letter and if you do so, all collection activity must be stopped until the debt is verified.
Read up on your rights here, get template letters to send and also make a complaint at this government site: http://www.consumerfinance.gov/
Also file a complaint with your State Attorney General's office.
List of State AG’s offices: http://consumerfraudreporting.org/stateattorneygenerallist.php
File a complaint at the NY State AG's Office here: http://www.ag.ny.gov/ - cateTA-DA !!! This was call #660 !!! from Portfoolio since their barrister Pearson wrote us a letter 4 1/2 years ago stating the vermin he works for had "decided to cease collection efforts" on a debt he admitted was not verifiable. Keep calling, sweet Portfoolio, because even though not a single one of your thousands of calls since April of 2009 has ever been answered, surely, one of these days, we will pick up the phone and agree to send a big check to your recovery facility. You just gotta have faith and persistence, sweet vermin.

- Patty.| 1 replyThey just called again, I thought they couldn't do this on a Sunday, they asked for 'Mike' I told them there isn't anyone here by that name, so we'll wait & see what tomorrow brings, [***] !!!!!
- Caller: Portfolio Recovery.
- Call type: Debt collector
- Alfalfa replies to Patty.Unfortunately---the FDCPA does not state debt collectors are not allowed to call on Sundays. You have to write and tell them otherwise (for what little good it will do, as PRA basically does as they please). If they continue calling, let them know you will take legal action against them for harassing a non-debtor, which is the only recourse you have in this situation.
- C SilverAlthough Portfolio Recovery (PRA) is the largest among debt buyers, their model is similar to NML and Elliot Capital, hedge funds founded by Paul Singer. His model - buy defaulted nations' debts for pennies on the dollar and then use US courts to force full face-value collection on the original debt-including asset seizure. It is a successful formula - even if debt has been restructured or written off.
What PRA hopes is that you'll provide them am opportunity to collect through the courts and seize any assets you might have. Check with your state's debt collection laws if you actually have uncollected debt. If not, check w/an attorney on pursuing legal remedies.- Caller: Portfolio Recovery

- Lampman replies to waltYou do not have to run around the country. They must sue you where you live. Not where there business is. So in essence they have to send someone or hire a local attorney .
- catePortfoolio Recovery must have gone on vacation-- they have all gone to the beach for sun and fun.
This is the last number they called from, and it was almost four weeks ago! What is happening?
Of course, there are pest calls from other places, some guy in India wants to fix my computer, and somebody right here in Pennsylvania sez I won a free trip to the Bahamas...but after six whole years of almost daily calls from Portfoolio, none of them ever answered, it is a bit sad to go so long without any contact. Sigh.

- KNOW THE LAW| 1 replyThese predators call on Sundays, which is against the law. If you live in the New York State area, they CAN NOT collect a debt from you unless the company has a NY Department of Consumer Affairs Debt Collectors licence number. THESE PREDATORS DO NOT HAVE A LICENCE. Ask them for that number before you give them your name, if they cannot, you should immediately hang up until they provide this information
- Caller: Portfolio debt collector (unlicensed in NYS)
- Call type: Debt collector
- BigA replies to KNOW THE LAWSunday calls are not illegal as long as they remain between the hours of 8am and 9 pm your time. As far as a license, there is no New York state license, there is a New York City and a Buffalo license required. Now your best defense instead of hanging up is detailed in this thread several times, most recently on this page. Perhaps you should read it and then go to the CFPB links to learn more about how to deal with these people.
