I simply showed up at my local court at the appointed time having ignored every request by the scum bag collection agency and told the judge that the debt was beyond the statute of limitations. Bam, said scum bags were out the money they had to pay the long distance attorney and they got nothing from me. Good for them.
ALWAYS defend yourself even if you're guilty as sin. These scumbag collection agencies are not the original debtor who has long ago written off the debt and they deserve no consideration or mercy. Tell them you will see them in court. NEVER give them a default judgement. Make 'em pay for it them make 'em pay again. Even if you lose in court, which you will if it is within the statute of limitations, they lose because I still won't pay. Anyone who comes after me is going to lose. Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of the date of the letter and if you do so, all collection activity must be stopped until the debt is verified.
