- Steve| 10 repliesA lot of these companies buy up old debt, sometimes so old you may have forgotten about it. In most cases like that the statue has run out on the debt, BUT admitting you owe it can in some cases actually give them full legal rights to pursue it in court. Not saying anything is the best move. This advice comes from my lawyer, who also happens to be a judge.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of the date of the letter and if you do so, all collection activity must be stopped until the debt is verified.

They call me morning, noon and even into the late night, Several times a day. and all that it is $172.00 LabCorp bill that my insurance says I am not required to pay. We have played mail tag for months now they just call. My attorney even sent them a letter telling them to cease calling and if they want to talk to call him. He has now contacted the Alabama Attorney General's Office to file a complaint.
- BigA replies to BarbYour attorney should be filing a law suit against them. I count at least 6 violations of the FDCPA at a minimum. There is also a good possibility they are violating Alabama State Collection laws. Your attorney might not be the right person to bring these lawsuits, so ask him/her for a reference.

- FeliciaThey're only allowed to call you a certain number of times per day, so my new tactic when they call is to pick up the receiver (or answer the cell phone), then put the phone or receiver face down and walk away. It counts as a "connect" to your number, they've gained nothing with that call, and it's a great satisfaction to hear them going "Hello? Hello? Hello?" hahaha. I'm not able to block numbers from my cell phone, so I do this instead.

- PosterThey are what is called a scavenger debt collector. I can not speak for anyone else but scavenger debt collector's never ever receive payment from me because I do not acknowledge nor am I legally bound to pay scavenger debt collectors. I never acknowledge the debt and in this case it is over a decade old.
And my credit report is squeaky clean. They have not filed on it. Let them. I will have it removed.
Too bad applying for work means the government sells your name and telephone number to these people.
