- RudeBoy| 1 replyPayday loan.....collection.....trying to use scare tactics......all bs!!!
- BeastMode replies to RudeBoyThe debt collector says one of the following to you. He or she will also say a variation of the same thing to your friends or family:
I am on my way to the court to serve you with a lawsuit for bank fraud. You will go to prison for this.
I am sending a local sheriff to your house today to arrest you for bank fraud. You bounced a check and now you are getting arrested.
I have a judgment against you for bank fraud because you bounced a check. Even if you filed bankruptcy, you can't wipe this out because you committed fraud.
All of this is untrue.
While the calls to friends and family might not end, you can stop the calls to yourself. You merely have to be strong and say to the debt collector that you know he is a fraud. You know he is not going to do anything, and you know he is going to keep calling.
Just say, "OK, I understand. Sounds serious, but I don't believe you. I know this is a scam. I assume you will be calling me a lot, but I know you are not going to do anything. I guess we will be talking again tomorrow."
Period. All my clients that say this tell me that the collection calls stop. The collector is trying to scare you into paying. Once he or she realizes you are not scared, he or she moves on to the next victim.

Follow us: @Bankrate on Twitter | Bankrate on Facebook - Lupe SanchezI received a voicemail from them saying they filed a civil suit against me for two counts of fraud. I have tried to call back to basically tell them that I have no outstanding debts, nothing is listed on my credit report and I have a credit score of 747 and to stop calling. However, I have gotten no response on any number. How companies can call and harass you like this is beyond me.

- blondy| 1 replyI received a call from a Amanda Rogers at work and she threatened me to come serve me at my job and i explained that i would get fired if she done that. She didnt care she came anyway and i lost my Job! This Company should not be able to do this to people!
- Badge714 replies to blondyIs it 'Blondy', or 'Bologna'? You cannot be fired from a job over debt. Of course, 3rd world criminal scammers would like people to believe that. That way, when they call, you'll feel you'll have to pay extortion on fake debt.
- thequeen| 6 repliesI was contacted from a 888 408 9655 #. I spoke with an arbitrator who stated that i had the opportunity to resolve the case outside of court on my own accord or they would issue out a warrant . it was from a payday loan i pulled out years ago, which i did owe but why would they press charge??? i guess i should have read the fine print on the legal contract. you people think that this is fake well you guys arent too smart i would think...... b/c the next day the sheriff sure did come to my job to arrest me!! this sh*t is real man! you better take care of your business instead of thinkiing youre gettimg off on these people b/c they will pursue you! and my boss fired me! luckily my dad paid the bond , but now i owe all this money and stuff and had to get an attorney which is not cheap let me tell you! so good luck to yall!!
- Slim replies to thequeen| 1 reply>> the next day the sheriff sure did come to my job to arrest me! <<
If that is true, you should be able to give us the information at the top of the arrest warrant, since it is now "public information".
Give us the district court name and location, the name of the judge or magistrate, the docket number, and the list of charges.
Can you do that, to prove your statement?
I betcha you can't. You didn't even give the physical and web address of the company that uses this phone number, so we could check their validity.
Do not bother to return and argue these points, unless you can provide the data I requested.
(Y'see, we KNOW that ordinary debt is NOT a criminal matter ... it is civil ... and the sheriff is not involved) - thequeen replies to Slimokay so i dont carry that info around with me idiot i mean seriously who does that. and since you seem to be so offensive you must be a person thats in my shoes too. handle your business partner is all i have to say good luck!
- HorseFYI.....Do not pay this debt until they mail the details to you in writing . The statute of limitations may have expired.....check here to see 1st.... http://www.fair-debt-collection.com/statute-limitations.html .If it has expired and it is not on your credit.....then they have no recourse. Just superficial threats....and scare tactics. Take a deep breath ....and then decide what you want to do. It's not the end of the world. Without debt....there wouldn't be a such thing as money. Get a fresh start....and try to get yourself in a place where you never have t
o borrow "expensive" money again. The people that are calling you are probably in a worse predicament than you were/are.They have to scare the crap out of you to pay their bills. Good luck. - natthis place called me and said i needed to pay this dept i had with a pay loan... my bank told me it came up as fraud and i called the pay loan place and they said dont pay them you do not owe them that money.

Was told I needed to call back at 888-408-9655 to discuss. I was given reference# CC2014151256. Really? I can smell scam and I sure won't be calling them. If they're so desperate, then send all this in writing as required. Besides, why would this guy from processing call me to give me a heads up? Sorry but I am quite aware of these scams so I'm not falling for it.

- Ben in Cali replies to thequeen| 2 repliesIf you read the fine print of a payday loan, it is true that if you fail to pay it back that it is like bouncing a check. You can be prosecuted. It just depends if the collection company wants to put in all the time and effort to take it that far. Usually if you got a pay day loan from a company that is in another state say like New York and you live in California the chances that they will push it that far are very slim. Be warned though you can have a warrant for your arrest because it is considered check fraud.
- ShillKill replies to Ben in CaliOh really? Please cite specific criminal law that states that a postdated check for a PDL falls under check fraud or "hot check" statutes. Or even a few decent news articles to back up your claim.
I eagerly await your prompt and erudite response
Note to readers --- the legal advice you get from the Internet is worth exactly what you pay for it. - ShillKillFor at least the last year, an illegal group of debt collectors have been terrorizing consumers, their family, friends, and employees threatening to arrest the individual of an unpaid loan or other debt (their generally don't even owe). Be aware debt is a civil matter, not a criminal matter, and you can't be arrested. They threaten a warrant if the victim does not pay a sum of money by the credit card over the phone.
Some of the people they are calling do not owe a debt. Others they are calling have already settled their debt with the organization who owns the accounts. Even if you do owe a debt, do not be deceived by the actions of this group. Many of the accounts they are attempting to collect they do not own. In other words, if you pay these people, that is not going to clear your debt with its rightful owner.
Although when pressed the callers give the victim an address in Columbia South Carolina (usually a vacant lot) or Atlanta GA (often a parking lot near the bus station or a Peachtree Road Address). They are actually out of the Charlotte North Carolina area. The scammers are using the following business names (and there are many others, and they seem to create new ones daily). They will normally answer the call back number as “Investigations”. They often call people with a recording claiming they are looking for a "defendant"

http://www.paydayloaninfo.org/state-information
States where payday lending is allowed
The page for each state where payday lending is legal gives the key cost of loan terms under state law. Look for the cost of a payday loan in dollars and annual interest rate for a 14-day $100 loan. Each page lists the maximum number of loans a consumer can have, any limits on loan renewals and requirements for extended repayment plans. Collection limits spell out the fees lenders can charge if the loan is not repaid and whether the lender can use or threaten criminal action if a borrower is unable to make good on the check used to get a loan.
States where payday lending is prohibited
In states that still have small loan rate caps or usury laws, the state page gives the citation for the law that limits rates, and the small loan rate cap.
Contact Information for State Regulators
All state pages list the state payday loan or small loan regulator, contact information and web site. Links to state complaint forms, instructions for filing complaints, and information about payday loans are provided if available. - CWG40 replies to thequeenYou're a total shill. Only judges issue warrants and they are only issued to duly constituted law enforcement officers on application that there is probable cause to believe that the person named did in fact commit the crime. They are NOT ISSUED TO DEBT COLLECTORS OR ARBITRATORS OR MEDIATORS OR WHATEVER NONSENSE TERMS YOU WANT TO USE! Warrants are only served in hand, by duly consisted law enforcement officers . And only in criminal cases.
Like I say, being in debt is not a crime. You can't be arrested for ordinary civil debt. Period.. DEBT COLLECTORS OR ARBITRATORS OR MEDIATORS OR WHATEVER have no influence on the criminal justice system.
In any event you were not arrested-- at least for being in debt.
But who knows what might happen in the future if you keep up your debt scamming ways.....
