Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of the date of the letter and if you do so, all collection activity must be stopped until the debt is verified.

I not only told them they have the wrong number, but told them they need to stop calling us. I am ready to start collecting my $1500 fine per phone call through Morgan and Morgan.

Just report and refuse to answer phone. If number is unknown, let them leave a message and don't return calls to anyone you don't recognize.
- BigA replies to Georgia| 2 repliesThere is nothing in the law that says they can't call you 7 days a week or on holidays. They are required to only call you between 8 am and 9 pm your time. Everything you need to know is in my post that I made on Dec. 16th. Read it and use the information to your advantage. Knowledge is power and in this case will keep you from being a victim of a crime perpetrated by Portfolio.

I told them and they said it was in my name so I owed it whether I did or not . They still call but I do not answer. They will not send proof of anything I just wish they would stop I have told them to but that does not work.

We recommend that you send it certified, return receipt mail so they cannot say they never got it. Also file complaints at the proper agencies, and then sue them.
