Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of the date of the letter and if you do so, all collection activity must be stopped until the debt is verified.

- Nancythey call me from many phone numbers have been doing so at all hours of the day and night for over 2 years and do not leave messages they have told me I owe money and are attempting to collect the debt and hang up on them after telling them it is harassment, I have tried to resolve this issue but am not paying late fees on a card which was not in use. Once it is cancelled an been paid off it is null and void.

- Information replies to WolfmanJack| 1 replyAdd to the fact that are more than likely trying to collect on zombie debts. These are debts that are no longer "legally" collectable meaning they cant take you to court or garnish or even threaten legal action. It is against the law. They can try and get you to pay but you are under no legal obligation to do so and I would say it is probably not in your best interest to ever pay them or even agree to pay them someday. Know your rights and check your states statute of limitations on debt collection.
- WolfmanJack replies to InformationOnce again, we have misinterpretation of the SOL. The SOL sets the time limit for bringing a law suit. Garnishment cannot happen without a judgement, unless it is for a student loan, the IRS, or a court ordered payment of some sort (i.e. child support, restitution, fines. etc.). There is no legal limit on collecting on debt, except as Resident47 pointed out in there are 2 states that set a limit with the SOL. That leaves 48 that don't. Now if they get you to pay even $1 on that loan, the SOL resets.
- nky2015 replies to js| 2 repliesIt is Portfolio Recovery and they don't mess around. If your debt is over $500 they'll court order $ out of your checking account that u never gave them info on. Since it's a court order your basically screwed. I mever even spoke with them and they took over a grand out of my acct leaving me in the negative. Oh and the fee for any bank to process it is $80. I despise Portfolio Recovery!!!!!!
- Mike in MD replies to nky2015So you ignored a court summons? They cannot get a court order without you being served. But if you fail to appear, they can get a default judgment. Then they have to go back to court and get the order to take money from your account and you will be notified before monies are taken. Something does not add up here. *Sniff sniff* Do I smell a shill?

They have to properly serve you Then you either ignore the summons for the hearing and they win by default, or you go to court and lose. Which would be an impossibility if you had a good lawyer because they probably don't have chain of title and your lawyer should be counter suing them for FDCPA violations.

If more and more people would do that, their profit margin would go to 0 and they would be out of business (also filing complaints at the proper agencies helps a lot also).
- WatchingsurfAlthough it is illegal to take money from your checking account without a judgment and proper procedures, they have done this. I have had this happen, due to monies owed by my husband, over 10 year ago. I have a legal background and know my rights and states rights. I retained my attorney, and it still took months to get the money back. I was not able to sue them, because they did return the money to my account; even after they emptied my checking account, causing over draft fees, at Christmas time. These collection agencies are scumbags and rarely follow the ethical and/or legal ways of maintaining the money (its a financial bounty hunter)
