It is best to turn off the ringer if you want to sleep cause they will wake you up! Better yet, keep changing your number like they do. Report them to the Federal Trade Commission & FCC.

- Ayrton Carson replies to annoyed in Fl| 1 replyBecause it is a debt collecor rather then a telemarketer there are slighty different rules .Bill collectors are not bound by the do not call list but consumers still have rights.
- Collectors can't call during inconvenient times. There isn't an official definition of what times are inconvenient but if they call between 10 P.M. and 8 A.M. the call will probably qualify .
- They can't call you at work once you tell them not to.
- They can call your family and friends to ask for your address but can only call each friend only once.
- Once you send them a certified letter saying you want them to stop calling they must stop. It's important to keep a copy of the letter and the certified mail receipt so you have proof you asked them to stop.
- Once they speak to you they must send you a notice revealing where the debt originated from, the amount owed and how to proceed if you don't feel you owe the money.
If they break these rules you can sue them although in most cases involving bill collectors the max payout is one thousand dollars. - J CollinsGot all call, could not answer at the time. I called them back no answer after 20 rings. Blocking them.

Trying to collect on a debt we settled with Capitol One, almost 10 years ago. They've been informed the debt was settled, they keep calling.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of the date of the letter and if you do so, all collection activity must be stopped until the debt is verified.

Some Tips:
*Keep all messages
*Take a picture of your Caller ID
*Keep any and all conversations recorded to your states recording laws, some require they be told, others do not. This can be transferred to a recording device.
*Keep a notebook handy for writing time,date, who you spoke with and what the conversation detailed.
*Check your SOL for your state as well.
*Attorneys need to be licensed as a DC to collect, all DC's must be licensed in their state as well as yours if different.
