Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of the date of the letter and if you do so, all collection activity must be stopped until the debt is verified.

My bankruptcy was done 15 yrs ago in federal court and the calls began 5 years later. These low lifes buy up old debt for pennies on the dollar hoping to get someone dumb enough to restart the clock on old dismissed debt. Do not be fooled. Do not answer these calls. They were severely fined in New York but still they persist in other states. Know your rights. Just because your phone rings it does not mean you have to answer.

There is always the chance your callers are foreign criminals, but if they are an actual US Collection agency - they're in big trouble. In many US States it is illegal to try and collect on debts canceled by bankruptcy. Do a web search on your State & see what comes up.

Pissing me off. they are trying to collect on a debt that is 15 years old. and was made by an XXXXXXX roommate we had. they refuse to speak to them. I am not a dead beat, but this is not my debt and isn't there a statute of limitations of some debts.

We tell them that they have the wrong number and they continue to call anyway. We block their numbers, but they change them and change their caller id information.
We are not going to be harassed into paying someone else's debt, so I really don't know the benefit of trying to contact someone, for years, through an inaccurate telephone number.

- BigA replies to Wendi| 2 repliesWrong way to handle this. Portfolio is a known criminal enterprise operating as a debt collector. They have hundreds (if not thousands) of numbers they call from either spoofed or not. So, here is what you need to do. Take the advice or put up with the calls.
Your choice.
You need to send them a certified, return receipt debt validation, cease and desist calling, or "not me" letter. You also need to report them to the proper agencies to which I have provided links to. Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment. If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it.
