Some Tips:
*Keep all messages
*Take a picture of your Caller ID
*Keep any and all conversations recorded to your states recording laws, some require they be told, others do not. This can be transferred to a recording device.
*Keep a notebook handy for writing time,date, who you spoke with and what the conversation detailed.
*Check your SOL for your state as well.
*Attorneys need to be licensed as a DC to collect, all DC's must be licensed in their state as well as yours if different.

I don't believe Capital One owns them however. The law gives you the ability to do something yourself. First send them a debt validation, cease and desist calling, or "not me" letter by certified, return receipt mail. Then file a complaint with the CFPB, and then get a consumer lawyer on a contingency basis and sue them.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

- AJCalled cell phone, left no message. No name on caller ID, so it was probably a scam / telemarketer call, or Portfolio Recovery according to posts on this thread.
If you receive many calls from Portfolio Recovery, check the internet for attorneys who specialize in suing debt collectors. A friend of mine in California did so, and received about $2,000 in statutory damages. It was a contingency case so he didn't have to pay anything up front. Portfolio Recovery calls my cell about two to three times a day from numbers with area codes for California, Tennessee, Alabama, Kentucky, Georgia, Pennsylvania and Illinois. It never leaves a message.
I talked to an FDCPA attorney who told me I could obtain $500 per call from Portfolio Recovery for unwanted calls, but that I would have to notify them beforehand that I don’t want them to call me. You might also want to contact an attorney.
