- AC| 5 repliesThis phone number called me in regards to owing Dillards. They are debt collecting agency and wants to know how am I going to pay them Debit or Credit card. I told them I can't pay them. I hang up called Dillard asked the associate in Dillard on how much I owe. She took my SSN and told me that I wasn't listed in any of their credit or some type of owing them. It sounds like they are a scam and I think, most definitely, they are.

- Becca replies to ACIt also could be that the debt is so old that you're not in the system anymore. Portfolio recovery buys very old debt and tries to collect on him even though the statue limitation has passed.

No they are not allowed to call between the hours of 9 pm and 8 am your time. I am going to tell you what you need to do. Take the advice and you end up with money in your pocket and the harassment will stop.
You need to send them a certified, return receipt debt validation, cease and desist calling, or "not me" letter. You also need to report them to the proper agencies to which I have provided links to. Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment. If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it. Here is the rest of what you need to know:

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
