- Angel| 1 replyThese people are the scum of the earth. If you get any calls from a number that you don't recognize don't answer. You can't block these people because they have to many phone numbers to count. If a debt collector is calling and they are legitimate they will leave a message something like "I need to speak with Jane Doe as soon as possible regarding a personal financial matter." They are not allowed to say anything about your debt because it is personal information and not allowed to share with anyone else. These scum bag companies like Portfolio Recovery and Midland Credit have been sued by the FTC and had to pay millions of dollars in fines. They don't care because they have so many people that buy into their threatening tactics that they collect millions.

- BigA replies to BerlyDid you tell them to stop? Did your employer? Did you follow it up with a letter as required? If you did all those things you now have an FDCPA claim against them. Here is what you need to do, or you can simply allow them to break the law and continue harassing you.
You need to send them a certified, return receipt debt validation, cease and desist calling, or "not me" letter. You also need to report them to the proper agencies to which I have provided links to. Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment. If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

Some Tips:
*Keep all messages
*Take a picture of your Caller ID
*Keep any and all conversations recorded to your states recording laws, some require they be told, others do not. This can be transferred to a recording device.
*Keep a notebook handy for writing time,date, who you spoke with and what the conversation detailed.
*Check your SOL for your state as well.
*Attorneys need to be licensed as a DC to collect, all DC's must be licensed in their state as well as yours if different.

- AJCalled cell phone, left no message. No name on caller ID, so it was probably a scam / telemarketer call, or debt collector trying to scam someone on a zombie or nonexistent debt. If debt collector, then robot didn’t leave message because it’s Illegal to call cell phones.
- AJCalled cell again, twice in one day. First call at 9:04 a.m., second one at 6:27 p.m. I decided not to block the numbers because the telemarketer/scammers/debt collectors spoof another caller ID. Let's see if they call a third time.
